What is trademark registration?

A trademark is a mark used to distinguish the goods and services of different businesses. Its composition is highly diverse, and it can include words (including personal names), signs, graphic designs, letters, wordmarks, numbers, graphic elements, colors, sounds, smells, the shape or packaging of goods, or a combination of these. It is important to note that only marks that can be presented in written or pictorial form are eligible for trademark registration.

Why is trademark registration necessary?

Once a trademark is registered, you have the exclusive right to use it on the designated goods and services. If other businesses use your registered trademark on the same or similar goods or services without your permission, it constitutes infringement, and you have the right to pursue legal action against them. Conversely, if a trademark is not registered, it will be difficult to prove your legal ownership in the event of a dispute, and the legal protection you can obtain will be quite limited.

Legal protection

After registering a trademark, a company owns the exclusive right to that trademark, and other companies are prohibited from using the same or similar mark on similar goods or services. This effectively prevents infringement and provides a legal basis for protecting rights in the event of infringement.

Brand identity

Trademarks, as brand identifiers, help consumers recognize and differentiate different goods or services. This not only increases brand awareness but also enhances consumer trust and loyalty to the brand.

Market competitive advantage

Enterprises with registered trademarks are more competitive in the market, effectively preventing vicious competition and infringement by companies in the same product category, and protecting their own economic interests.

In conclusion, trademark registration is not only a legal means of protecting a brand, but also a crucial component of a company's success. Registering a trademark provides legal protection, enhances brand image, and ensures a competitive edge in the market.

Hong Kong Trademark Registration Instructions

Regarding applicant eligibility, Hong Kong law does not impose any special restrictions; both natural persons and legal entities can file trademark registration applications. Furthermore, the law does not require applicants to have actually used the trademark before submitting the application; simply stating that the trademark is "in use" or "intends to use" at the time of application is sufficient.
The types of trademarks that can be registered are very diverse, including designs, names, signatures, words, fonts, numbers, and signs composed of different shapes or colors, as well as combinations of the above elements. In addition, main graphic elements and geographical names are also within the scope of applications. Service marks are also protected by law in Hong Kong; even service marks in the retail industry can be submitted for registration normally.
Hong Kong trademark registration has a special provision: the Trademark Registry has the right to require applicants to complete all registration-related procedures within 12 months from the filing date. If the applicant fails to fulfill this requirement on time, the trademark registration application will be deemed automatically abandoned.
